These Terms of Use ("Terms") govern your use of the Sweep app (the "App") provided by Vidus Teknoloji Anonim Şirketi ("Vidus6", "we", "our", "us"). By downloading, installing or using the App, you agree to these Terms. If you do not agree, please do not use the App. How we handle personal data is explained in the Sweep Privacy Policy.
Who can use the App
You must be at least 13 years old, or older if required in your country, to use the App. If you are under the age of majority where you live, you may use the App only with the permission of a parent or guardian, who accepts these Terms on your behalf.
Your licence
We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App on devices you own or control, in line with these Terms and the rules of the app store you downloaded it from. You may not:
- copy, modify, reverse engineer or create derivative works of the App, except where the law allows it;
- rent, sell, sublicense or redistribute the App;
- circumvent usage limits, subscriptions or security features, or automate access to our servers;
- use the App to break the law, infringe others' rights, or send harmful, abusive or illegal content.
Subscriptions and purchases
Some features are available through in-app purchases or auto-renewing subscriptions.
- Billing: payment is charged to your Apple ID or Google account when you confirm the purchase. Prices are shown in the App before you buy and may vary by country.
- Auto-renewal: subscriptions renew automatically at the end of each period at the then-current price, unless you cancel at least 24 hours before the end of the current period.
- Free trials: if a trial is offered, the subscription starts and is charged when the trial ends unless you cancel at least 24 hours before it ends.
- Cancelling: manage or cancel subscriptions in your App Store or Google Play account settings. Deleting the App does not cancel a subscription.
- Refunds: purchases are processed by Apple or Google, and refund requests are handled under their policies. Nothing in these Terms limits any right to withdraw or obtain a refund that you have under applicable consumer law.
- Price changes: we may change subscription prices; you will be notified as required by the app store and can cancel before the new price applies.
Your content
Content you create or add to the App remains yours. You give us permission to process that content only as needed to provide the features you use. You are responsible for having the right to use the content you add.
About Sweep
Sweep removes photos and videos only when you confirm. Deleted items are moved to your device's "Recently Deleted" album and follow your device's rules for permanent deletion. Keep backups of media you do not want to lose.
Intellectual property
The App, including our software, designs, text, graphics and logos, and the names Vidus6 and Sweep, belong to Vidus6 or its licensors and are protected by law. These Terms do not give you any right to use our trademarks.
Third-party services
The App relies on or links to third-party services, such as the App Store, Google Play and websites. Their own terms and policies apply, and we are not responsible for their content or practices.
Changes and availability
We may update, change or discontinue the App or its features, including to meet legal or platform requirements. We aim to keep the App available but cannot guarantee that it will always be uninterrupted or error-free.
Disclaimers
To the fullest extent permitted by law, the App is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.
Limitation of liability
To the fullest extent permitted by law, Vidus6 is not liable for any indirect, incidental, special or consequential damages, or for loss of data, profits or goodwill, arising from your use of the App. Our total liability for any claim relating to the App is limited to the amount you paid us for the App in the 12 months before the claim. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for gross negligence, wilful misconduct, or death or personal injury caused by negligence, and your statutory rights as a consumer.
Ending your use
You can stop using the App at any time by deleting it and cancelling any subscription. We may suspend or end your access if you seriously or repeatedly break these Terms, or if the law requires it.
Apple App Store
If you downloaded the App from the Apple App Store, the following also applies:
- These Terms are between you and Vidus6 only, not Apple. Vidus6, not Apple, is solely responsible for the App and its content.
- Your licence to use the App is limited to Apple-branded devices you own or control, as permitted by the App Store Usage Rules.
- Apple has no obligation to provide maintenance or support for the App.
- If the App fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price of the App, if any. To the maximum extent permitted by law, Apple has no other warranty obligation for the App.
- Vidus6, not Apple, is responsible for addressing any claims relating to the App, including product liability claims, claims that the App fails to meet legal or regulatory requirements, and consumer protection or privacy claims.
- If a third party claims that the App or your use of it infringes their intellectual property rights, Vidus6, not Apple, is responsible for the investigation, defence, settlement and discharge of that claim.
- You confirm that you are not located in a country subject to a US Government embargo or designated as a "terrorist supporting" country, and that you are not on any US Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
Governing law
These Terms are governed by the laws of the Republic of Türkiye. The courts and enforcement offices of İstanbul have jurisdiction. If you are a consumer, this does not deprive you of the protection of mandatory laws of your country of residence or of your right to bring claims before the consumer arbitration committees or courts where you live.
Changes to these Terms
We may update these Terms. The current version is always on this page with its "Last updated" date. If a change is significant, we will let you know in the App. Continuing to use the App after an update means you accept the new Terms.
